This website is owned and operated by Get About Mobility ABN 41 699 467 005 (“Get About Mobility”, “we”, “our ” or “us”). By using this website, you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you must refrain from using this website or making a purchase from this website.

The Terms of Use governing the use of this site comprises of these terms and conditions, any policies or any terms and conditions appearing on this site and any laws or regulations applicable to this site.

Prices of products displayed on this site are in Australian Dollars and include GST to applicable products.

Prices for our products are subject to change without notice.

Information on this website may contain typographical errors, technical inaccuracies or other errors and may be changed at any time without notice. We have a policy of continuous improvement of products and reserve the right to make improvements or changes to products without notice.

When you place an order for a product on this site you agree to use the product only for the intended purpose and in accordance with the instructions provided by the manufacture.

Images have been provided for illustration purposes only and we do not guarantee that the image will reproduce in true colour nor that any given image will reflect the full design or options relating to that product.

 

Express Warranty

In addition to all rights and remedies to which consumers may be entitled under Australian Consumer Law and any other relevant legislation, Get About Mobility offers a further Express Warranty for products

The benefits given to consumers by the Express Warranty are in addition to other rights and remedies that may be available under a law in relation to the products to which the Express Warranty relates. This Express Warranty does not exclude, restrict or modify any such statutory rights or remedies.

Get About Mobility warrants the products sold by it are free from defects in material and workmanship for the warranty periods specified.

 

Warranties

All products are covered by relevant manufactures warranty. The warranty length may vary by product provided by the manufacture which is usually indicated on the product description on their website.

 

Returns Policy

Australian Consumer Law

Products sold by Get About Mobility come with guarantees that cannot be excluded under Australian Consumer Law. Consumers are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. Consumers are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

A "major failure" as defined in the Australian Consumer Law broadly is one where a reasonable consumer would not have acquired the goods had the consumer been fully aware of the failure, the goods are unsafe, substantially unfit for purpose or departed significantly from the demonstration model or sample. In this regard you should refer to the Australian Consumer Law.

Consumer guarantees cannot be excluded and are in addition to any express warranty (warranty against defects) you are given.

There may be circumstances where you are not entitled to a remedy.

When will goods be accepted for return?

  • When there is deemed to be a breach of a Guarantee under Australian Consumer Law or other applicable consumer protection laws or regulations; or
  • When there is deemed to be a breach of any express warranty given by Get About Mobility or the manufacturer of the goods, and the goods are returned in accordance with the terms of that warranty.

      Change of mind returns

      We offer an exchange or refund on some products for change of mind. You must inform us within 3 days of receiving your goods. However products returned must be in original condition and undamaged packaging as we do not repack. Products returned is your responsibility for return freight costs and a 20% restocking fee charged by the supplier. If you choose to return a product please contact us first.

      Credit card details must be supplied to us as security in these cases.

      If your product is damaged or defective, please contact Get About Mobility as soon as practicable at getaboutmobility@outlook.com or call 1300 168 902 and we will provide you with information about the return process, which may involve sending photo’s and other information to us. If we determine the product is damaged or is defective we will provide you with a new product at no extra cost to you. If we determine that the product is not damaged or defective and has been returned to us, we will return the product to you inclusive of extra freight charges you will need to pay.

      Clarification of defective or faulty product does not include fair wear and tear.

       

      Assessment and condition of goods for acceptable return

      Get About Mobility reserves the right to assess the eligibility of goods before accepting them for return. This includes reviewing the condition and age of the goods.

      All goods that a customer wishes to be assessed for return must be:

      • accompanied by valid proof of purchase documentation from Get About Mobility;
      • unaltered, unmodified, unmarked, undamaged and complete with instruction manuals, tags, labels and accessories supplied with the goods as part of the purchase.

      Please note that it may be necessary for the manufacturer of the goods to inspect the goods in order to assess eligibility for return. Get About Mobility will endeavour to procure such assessment within a reasonable time.

      While goods are being assessed, Get About Mobility will not be deemed to have accepted the goods for return.

       

      Non-returnable goods

      Other than any remedies under Australian Consumer Law or other relevant legislation, goods which are used in a way or environment that would create OH&S and hygiene risks may not be returned. This includes any goods that may have been soiled or exposed to biological contamination. This also includes but is not limited to goods used for: bathroom & bathing; toileting; toileting & hygiene slings; stockings & undergarments; pillows, bedding & protectors; continence products; bracing & supports; compression garments; personal kitchen aids; cutlery & crockery.

       

      Delivery Charges

      Where upon assessment it is confirmed that goods have breached a consumer guarantee under Australian Consumer Law, any shipping costs to return the goods to Get About Mobility will be at Get About Mobility’s cost. If the goods have not breached a consumer guarantee under Australian Consumer Law, any shipping costs to return the goods to Get About Mobility will be paid for by the consumer.

       

      What happens when your goods are accepted for return?

      Subject to any obligation of Get About Mobility at law to the contrary, when Get About Mobility accepts goods for return.

      For a failure to comply with a consumer guarantee which is not a "major failure", Get About Mobility may either: 

        • have the goods repaired or provide an identical replacement; or
        • provide a refund of the amount paid for the goods; within a reasonable time

        For a failure to comply with a consumer guarantee which is a "major failure" and cannot be remedied, you may either:

        • reject the goods and choose a refund or identical replacement or one of the same type and similar value (if reasonably available);
        • keep the goods and get compensation for any drop in value of the goods caused by the failure; or
        • agree with Get About Mobility to a repair of the goods.

        Under express warranty, Get About Mobility may either repair or replace the goods or offer a refund in accordance with the express warranty. If goods are accepted for repair, Get About Mobility will undertake such repairs within a reasonable time. All repairs will be undertaken as prescribed under the ACL.

         

        Orders

        Our orders are processed on the same business day.

        Once your order has been received by us and processed, you will receive confirmation of your order.

        For out of stock or back orders Get About Mobility will contact you to receive further instructions to your order.

        All orders are dispatched from our warehouses next business day after payment clearance.

        Once your order is processed Get About Mobility will obtain accurate delivery fees and confirm this with you before dispatching your order. 

        Cancelled orders after payment has been made and before dispatch of in stock goods will incur 20% restocking fee.

        Refunds will be deposited into a nominated bank account or credit card used for the payment.

         

        Delivery

        Delivery is available Australia wide and dispatched next business day.

        For delivery to most metro / inner city areas, please allow 2-5 business days, excluding public holidays from date of payment clearance.

        For delivery to remote / rural locations, please allow 5-7 business days, excluding public holidays from date of payment clearance.

        Upon delivery, inspect your orders’ packaging for any damage. If you notice damage to the box or packaging, please make note on the delivery consignment, if the courier driver is present. Please take notes and photo’s and contact us at getaboutmobility@outlook.com or phone 1300 168 902 as soon as practicable.

         

        Force Majeure

        We are not liable for any delay or any breach or default under these terms due to any act of God, labour dispute, difficulty in procuring materials, accidents, legislative restriction or other act whatsoever beyond the sellers control.

         

        Indemnity

        By accessing our website, you agree to indemnify us from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.

        The content contained on our website is protected by copyright. You may use our website only for your personal and non-commercial purposes. Except to the extent permitted by relevant copyright legislation, you must not use, copy, modify, transmit, store, publish or distribute the content on our website, or create any other material using content on our website, without obtaining our prior written consent.
